An Act to provide staffing ratios for day care providers.
Be it enacted by the Legislature of the State of South Dakota:
Section 1. That chapter 26-6 be amended with a NEW SECTION:
The staffing ratios applicable to a licensee providing day care for, and supervision of, children under this chapter are:
(1) One adult for every five children who are less than one-and-one-half years of age;
(2) One adult for every six children who are at least one-and-one-half years of age but less than three years;
(3) One adult for every ten children who are at least three years of age but less than four years;
(4) One adult for every twelve children who are at least four years of age but less than six years; and
(5) One adult for every fifteen children who are at least six years of age.
The adult-child ratio of mixed-age groups must meet the requirements of the age group that comprises the majority of the children, except, if children under three years of age are present in the group, the adult-child ratio for children under three years of age, as set forth in this section, must be maintained.
