An Act to provide for limited elk licenses to landowners.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That chapter 41-6 be amended with a NEW SECTION:

The Game, Fish and Parks Commission may, by rules promulgated pursuant to    41-2-18, set the number and type of landowner-on-own-land licenses for the hunting, taking, or killing of elk and establish who is eligible to apply for the license.

Upon receipt of the application prescribed by the Department of Game, Fish and Parks, and payment of the applicable fee, the department shall issue a landowner-on-own-land license that restricts the holder to the taking of elk, as designated on the license, from land owned, operated, or leased by the landowner within any unit, for the specified hunting season. For the purposes of this section, the term, landowner-on-own-land, means any resident landowner; and any nonresident who owns land prior to July 1, 2022.

The commission shall promulgate rules, in accordance with chapter 1-26, to establish fees for licenses issued under this section.

Any license issued pursuant to this section is not transferable.
