The "South Carolina Student Physical Privacy Act" aims to establish regulations regarding the use of restrooms and changing facilities in public schools and institutions of higher learning, ensuring that these facilities are designated for use only by individuals of the same biological sex. The bill defines key terms such as "changing facility," "restroom," and "sex," and mandates that public school districts and institutions of higher learning must not use funds to maintain or operate facilities that do not comply with these regulations. Violations will result in a penalty of twenty-five percent of the funds appropriated for the institution's operations.
Additionally, the bill provides individuals with a private cause of action for declaratory and injunctive relief if they encounter a person of the opposite sex in designated facilities or are required to share sleeping quarters with someone of the opposite sex. It also allows for the establishment of separate, private areas based on sex in settings where individuals may be undressed. However, the act does not prevent accommodations for disabled persons or young children needing assistance. The provisions of this act will take effect upon the Governor's approval.
