The "Sexual Offender Act" aims to enhance public safety by requiring the South Carolina Department of Motor Vehicles (DMV) to place a "Sex Offender" identifier on the driver's licenses and special identification cards of individuals classified as Tier II or Tier III sex offenders. This identifier will be printed in red and must be obtained within thirty days of the offender's release from the Department of Corrections. The DMV is authorized to charge a fee for this service. Additionally, individuals can remove the identifier upon termination of their sex offender status by providing appropriate documentation from the South Carolina Law Enforcement Division (SLED).
The bill also establishes penalties for non-compliance, classifying violations as misdemeanors that could result in imprisonment for up to three years and fines of up to five hundred dollars. The act will take effect once it is approved by the Governor.
