The "Safeguarding American Families Everywhere (SAFE) Act" aims to enhance motor vehicle registration processes in South Carolina by allowing applicants to voluntarily disclose if they or their family members have been diagnosed with specific disabilities or disorders. The bill introduces a new section, 56-3-125, to the South Carolina Code of Laws, which mandates that the application form for motor vehicle registration include language for this purpose. The disabilities and disorders listed include autism, ADHD, Down syndrome, Alzheimer's disease, traumatic brain injury, PTSD, diabetes, autoimmune disorders, deafness, blindness, and other mentally or physically limiting conditions.
If an applicant indicates a diagnosis on their application, the Department of Motor Vehicles (DMV) is required to include the designation "SAFE" in the motor vehicle record. Importantly, the DMV is prohibited from including any personal identifying information or specific diagnoses in the records. Additionally, the bill allows vehicle owners or co-owners to update their registration to add or remove the "SAFE" designation at any time. The act will take effect upon approval by the Governor.
