The bill H. 3968 aims to enhance the protection of South Carolina's critical infrastructure against electromagnetic pulses (EMPs) and geomagnetic disturbances. It proposes the addition of Article 29 to Chapter 1, Title 1 of the South Carolina Code of Laws, which includes definitions for "critical infrastructure" and "electromagnetic pulse." The South Carolina Emergency Management Division (SCEMD) is mandated to develop a detailed plan to harden critical infrastructure against these threats and to provide alternative energy sources for extended independence in case of grid failure. This plan must be distributed to all municipalities by January 1, 2026. Additionally, electrical utility distributors are required to offer programs for residential customers seeking EMP protection, allowing for installation and payment plans through monthly utility bills.
Furthermore, the bill establishes that municipalities or critical infrastructure entities that comply with the SCEMD's plan within one year will be eligible for grants from the General Assembly to assist with funding. The General Assembly is also tasked with providing multiyear funding starting in the 2025-2026 Appropriations Act to support the implementation of EMP protection and alternative power sources. The act will take effect upon approval by the Governor.
