The "Smart Heart Act" aims to enhance cardiac emergency preparedness in South Carolina public schools by mandating the development and implementation of a Cardiac Emergency Response Plan (CERP) for each school. This legislation requires that each public school district or charter school create a written plan detailing the steps to respond to sudden cardiac arrest incidents, including the establishment of a cardiac emergency response team, the placement and maintenance of Automated External Defibrillators (AEDs), and ongoing training for designated staff in CPR and AED use. The State Board of Education is tasked with developing standards and procedures for these plans, ensuring they align with nationally recognized guidelines.
Additionally, the bill amends existing laws regarding the AED program in high schools, stipulating that each school must have an operational AED accessible during school hours and athletic events. It also outlines training requirements for staff expected to use the AED and establishes immunity from civil liability for individuals and entities acting in good faith while responding to cardiac emergencies. The act is set to take effect on July 1, 2025, and will be applicable starting with the 2026-2027 school year.
