The "Smart Heart Act" aims to enhance cardiac emergency preparedness in South Carolina public schools by mandating the development and implementation of a Cardiac Emergency Response Plan (CERP) for each school district and charter school. This plan must outline specific procedures for responding to incidents of sudden cardiac arrest and include the establishment of a school-level cardiac emergency response team, the placement and maintenance of Automated External Defibrillators (AEDs), and ongoing training for designated staff in CPR and AED use. The State Board of Education is tasked with developing standards and practices for these plans, ensuring they align with nationally recognized guidelines.
Additionally, the bill amends existing laws regarding the AED program in high schools, requiring that each school has an operational AED accessible during school hours and athletic events. It also stipulates that all athletic coaches must receive training in CPR and AED use. The legislation provides civil liability immunity for individuals and entities acting in good faith while implementing the CERP or using an AED, except in cases of gross negligence. The act is set to take effect on July 1, 2025, and will be applicable starting with the 2026-2027 school year.
