The "Luke Barrett Act" aims to enhance cardiac emergency preparedness in South Carolina public schools by mandating the development and implementation of Cardiac Emergency Response Plans (CERPs). These plans will outline specific procedures for responding to sudden cardiac arrest incidents on school grounds and during school-sponsored athletic events. The act requires each public school district and charter school to create a CERP that includes the establishment of a cardiac emergency response team, the placement and maintenance of Automated External Defibrillators (AEDs), and ongoing training for designated staff in CPR and AED use. The act also provides immunity from civil or criminal liability for individuals and entities acting in good faith while implementing these plans, with certain exceptions for gross negligence.

Additionally, the act amends existing laws to expand the requirements for AED programs to all public schools, including charter schools, ensuring that AEDs are accessible during school hours and at off-site athletic events. It mandates that all athletic coaches receive training in CPR and AED use, and outlines the necessary testing and maintenance protocols for AEDs. The South Carolina Department of Education is tasked with adopting regulations to implement the act, which will take effect on July 1, 2026, and will be applicable starting with the 2027-2028 school year.
