The proposed bill, known as the "Citizenship Verification Act," seeks to amend the South Carolina Code of Laws by adding Section 23-1-260. This new section mandates that law enforcement agencies check the immigration status of all individuals arrested using the United States Department of Homeland Security's Systematic Alien Verification for Entitlements Program. Additionally, it requires that the immigration status of these individuals be recorded in their criminal records upon arrest or conviction.

Furthermore, the bill stipulates that the South Carolina Law Enforcement Division (SLED) must submit an annual report to the General Assembly by January 1st each year. This report will detail the number of individuals who were arrested, convicted, or both, and who are identified as being in the state illegally during the previous year. The act will take effect upon approval by the Governor.
