The bill H. 3205 proposes an amendment to the South Carolina Code of Laws by adding Section 59-18-322. This new provision mandates that any student whose performance on a statewide academic assessment in English/language arts or mathematics indicates they are performing two or more grade levels below their current enrollment must be retained at that grade level. The student will remain in the same grade until additional testing shows that they have achieved performance at their appropriate grade level.

It is also noted that these new requirements will be in addition to the existing stipulations outlined in Chapter 155, the South Carolina Read to Succeed Act. The bill will take effect upon receiving approval from the Governor.
