The "South Carolina Student Physical Privacy Act" aims to establish regulations regarding the use of restrooms and changing facilities in public schools and institutions of higher learning, ensuring that these facilities are designated for use only by members of one sex. The bill outlines definitions for key terms such as "changing facility," "restroom," "sex," and "sleeping quarters." It mandates that public school districts and institutions of higher learning cannot use funds to maintain or operate facilities that do not comply with the provisions of this article, imposing a penalty of twenty-five percent of the appropriated funds for noncompliance.
Additionally, the bill stipulates that during school-authorized activities involving overnight lodging, students cannot be required to share sleeping quarters or multioccupancy restrooms with members of the opposite sex, unless they are family members. It also requires that separate, private areas be provided for individuals based on their sex in settings where undress may occur. However, the act allows for accommodations for disabled persons and young children needing assistance. The act will take effect upon approval by the Governor.
