The "Rejecting Racism in Postsecondary Education Act" aims to amend the South Carolina Code of Laws by adding a new article to Chapter 101, Title 59. This legislation seeks to ensure that public K-12 and secondary schools maintain nondiscriminatory policies in accordance with federal civil rights laws, specifically Title IV and Title VI of the Civil Rights Act of 1964. The act defines key terms and outlines provisions to prevent discrimination, promote intellectual development, and protect the free exchange of ideas. It prohibits postsecondary institutions from compelling individuals to adopt or affirm specific beliefs related to race, ethnicity, or national origin, and restricts the use of diversity, equity, and inclusion (DEI) programs in hiring and accreditation processes.

Additionally, the act stipulates that postsecondary institutions cannot segregate or treat students differently based on race or ethnicity, nor can they require DEI statements from job applicants or students. Institutions found in violation of these provisions would be ineligible for state funding and could face legal action from individuals or the Attorney General. The act also includes measures for enforcement, allowing for civil actions against accrediting agencies that violate its terms, and establishes penalties for such violations. The legislation is set to take effect upon the Governor's approval.
