The bill H. 3195 aims to amend the South Carolina Code of Laws to enhance physical education and recess requirements for students in four-year-old kindergarten through eighth grade. It mandates that students receive a minimum of twenty minutes of unstructured outdoor recess each day, in addition to specified physical education time, which includes a minimum of one hundred fifty minutes of physical education and physical activity weekly for grades K-5, and sixty hours annually for grades 6-8. The bill also stipulates that recess must be held indoors during inclement weather and cannot be used as a form of punishment.
Additionally, the bill makes conforming changes to the roles of physical education activity directors and volunteers, allowing noncertified staff or adult volunteers to assist in supervising physical activities, provided they are approved by the district superintendent and appropriate liability insurance is in place. The bill redesignates Article 1 of Chapter 10, Title 59 as "Physical Education and Activity" and requires that all provisions be fully implemented by July 1, 2026.
