The bill amends Section 45-23-32 of the General Laws in Chapter 45-23, which governs land subdivision in Rhode Island, by introducing a new definitions section that clarifies terms related to land development. It specifically defines "minor subdivision" to include single-family infill subdivisions and oversized lot subdivisions. The bill outlines criteria for single-family infill subdivisions, allowing for the subdivision of an existing lot in areas serviced by public water and sewer, provided that the subdivision results in a maximum of three new lots, each limited to single-family detached residential use. The resulting vacant residential lots must be equal to or greater than at least seventy-five percent (75%) of the average lot size of all developed residential lots within two hundred feet (200') of the proposed subdivision, excluding multi-family residential lots. Additionally, the lots must be located on an existing improved public street.
The bill states that lots qualifying for this type of subdivision shall be reviewed under the requirements and procedures set forth in Section 45-23-38, but shall not require zoning relief solely based on the resulting reduced lot area of the newly created lots. The resulting subdivided lots shall benefit from reduced requirements as specified in Section 45-24-38 and/or may be eligible for processes outlined in Section 45-24-46, as applicable. The act is set to take effect immediately upon passage.
