SAFE Units are exempt from most provisions of the State Building Code, except for specific safety requirements outlined in the bill, including climate control, locking doors, smoke detectors, and compliance with electrical and plumbing codes. The bill also clarifies that SAFE Units are exempt from the Comprehensive Fire Safety Act, provided they adhere to the new regulations.

Additionally, the bill allows municipalities to construct SAFE Units by right if they have adopted relevant zoning ordinances or declared an emergency. It grants municipalities the authority to expedite planning and zoning procedures during emergencies, with a maximum duration of 180 days per year for such declarations. Municipalities are required to report on the nature of the emergency, the actions taken to address it, and the total number of individuals being served by SAFE Units within specified timeframes.

The legislation emphasizes the need for compliance with specific requirements for SAFE Units, including size, live loads, ceiling height, egress windows, plumbing and gas service, electrical provisions, ventilation, and separation between units. It also includes provisions for accessory units, such as bathrooms, and allows for the construction of SAFE Units on a non-emergency basis, provided they comply with applicable state building and fire codes.

The act will take effect upon passage.
