The bill amends existing laws regarding the sale and regulation of cigarettes, other tobacco products, and electronic nicotine-delivery systems in Rhode Island. It introduces a new definition for "electronic nicotine-delivery system shop," which refers to premises dedicated to the display, sale, distribution, delivery, offering, furnishing, or marketing of electronic nicotine-delivery system products, liquid nicotine containers, or vapor products to consumers over the age of twenty-one, in compliance with chapter 9 of title 11.

The bill prohibits the sale of flavored electronic nicotine-delivery system products, except at these designated shops, and mandates that age verification be conducted for all purchasers. Additionally, it specifies that ten percent of the revenue from sales at electronic nicotine-delivery system shops must be allocated to tobacco cessation programs established in 27-20-53.

The bill also imposes stricter penalties for violations related to electronic nicotine-delivery system shops, doubling the penalties for infractions and requiring that any costs associated with the storage and destruction of confiscated materials be borne by the shop from which the material was confiscated. These changes aim to enhance regulation and oversight of electronic nicotine products while promoting public health initiatives related to tobacco cessation. The act will take effect upon passage.
