The bill amends Chapter 12-2 of the General Laws by introducing a new section titled "Privacy protections for railway employees." This section establishes that any police report involving a railroad fatality, as well as all communications between police officers and railroad crew members involved in such fatality, shall not be made public. These reports must be maintained by the responding police department in a manner that ensures confidentiality. However, they will be accessible at all reasonable times, upon written request, to the following parties: (1) the host railroad; (2) the railroad of employment for any employee mentioned in the reports; and (3) any other person authorized by judicial order to obtain such information if access is necessary for the performance of their duties. Additionally, law enforcement officers and the office of the attorney general may also request access to these reports.
The bill further stipulates that communications between police officers and railroad employees regarding any railroad fatality incident may be shared with the authorized individuals listed, provided such access is necessary for the performance of their duties. A violation of these privacy protections is classified as a misdemeanor, punishable by imprisonment for not more than one year or by a fine of not more than $1,000, or both. The act is set to take effect upon passage.
