The bill introduces a new section, 45-22.2-12.1, to the Rhode Island Comprehensive Planning and Land Use Act, which authorizes municipalities to request a one-time extension of up to twelve months for updating their comprehensive plans. To qualify for this extension, municipalities must demonstrate active engagement in the update process, as determined by the Rhode Island division of statewide planning. The criteria for assessing this engagement include: (1) initiating the comprehensive plan update process; (2) engaging or procuring professional planning or consulting services; (3) conducting public outreach, workshops, or hearings; (4) coordinating with state agencies or the division; and (5) submitting draft materials or documentation for preliminary or formal review.
During the extension period, the municipality's existing comprehensive plan will remain in full force and effect for all purposes, including zoning consistency, regulatory compliance, and eligibility for state or federal funding. The division is also authorized to issue guidance or procedures necessary to implement the provisions of this section. The act will take effect upon passage.
