The bill amends Chapter 11-11 of the General Laws regarding "Disorderly Conduct" by introducing a new section, 11-11-8, which addresses the operation of recreational vehicles in a reckless or negligent manner that hinders the movement of other vehicles. Specifically, it establishes that individuals operating two or more recreational vehicles in such a manner on public ways or accessible areas can be charged with a felony, facing penalties of imprisonment for up to two and one-half (2.5) years and fines of up to two thousand dollars ($2,000). Additionally, individuals found to be in violation while wearing masks may incur an extra year of imprisonment and/or a fine of up to five hundred dollars ($500).
The bill also stipulates that any recreational vehicle used in the commission of such violations shall be subject to forfeiture at the discretion of the court. The final order for forfeiture will provide for the disposition of the vehicle, which may include use by law enforcement or sale at public auction, with proceeds directed to cover the costs of the forfeiture proceedings and deposited into the general fund of the municipality where the violation occurred. Furthermore, the bill ensures that no forfeiture will extinguish a perfected security interest held by a creditor in the property at the time of the filing of the forfeiture action, allowing possession to revert to the creditor if applicable. This act will take effect upon passage.
