The bill amends Chapter 16-21 of the General Laws by adding a new section titled "Termination for cause -- Non-teacher employees -- List maintained." It requires that whenever a non-teacher employee's employment with a school is terminated for good and just cause by a principal, superintendent, school committee, or other governing body of a public school, private school, school district, charter public school, or mayoral academy, the governing body must report the identity of the terminated employee and the reason for termination to the Rhode Island Department of Elementary and Secondary Education within sixty days. In cases where the termination is appealed, the report must be made within sixty days after the conclusion of the appeal, provided the termination is upheld.
Exceptions to this requirement include the nonrenewal of a contract without cause or unrelated to misconduct or performance, and terminations due to fiscal exigency or program reorganization. The Department will maintain a confidential list of non-teacher employees terminated for good and just cause, which will include the reasons for termination. This list will be updated monthly and will be accessible only to hiring authorities of private, parochial, charter, or public schools and school districts. The list shall not be considered a public record under chapter 2 of title 38 ("access to public records"), ensuring the privacy of the individuals involved. The bill is set to take effect upon passage.
