The proposed bill introduces the "Post-Secondary Student Health Insurance Plan Act" as a new chapter in Title 16 of the General Laws concerning education. This act prohibits public and private institutions of higher education in Rhode Island from automatically enrolling students in health insurance plans. Instead, students must explicitly accept or reject the coverage, which must be indicated on their tuition bill. Institutions are also prohibited from assessing any fees or premiums for health insurance coverage on students who have opted out.
The act allows institutions to require all students to maintain health insurance coverage as a condition of attending the institution. Additionally, it mandates that institutions maintain records of all student elections to accept or reject coverage for a minimum of three years. The office of the post-secondary commissioner is empowered to promulgate regulations to enforce compliance with these provisions. The act is set to take effect on January 1, 2027.
