The proposed bill, known as the "Super Speeder Accountability Act," establishes a framework for addressing excessive speeding and related driving violations through the mandatory use of Intelligent Speed Assistance (ISA) devices for eligible offenders. The act defines "eligible offender" as individuals whose licenses have been suspended due to excessive speeding, racing, or reckless driving where speed was a factor, as well as those convicted of multiple moving offenses.

Under the act, the Rhode Island traffic tribunal or district court is required to mandate the installation and use of ISA devices as a condition for license reinstatement. These devices utilize GPS technology to actively limit vehicle speed to posted or pre-set limits and are designed to be tamper-resistant. Offenders are responsible for the costs associated with leasing, installing, and maintaining the ISA devices, which must be operational for a minimum of twelve months following reinstatement.

The act also outlines the responsibilities of the Department of Motor Vehicles in administering the program, including notifying offenders of ISA requirements, verifying installation and functionality of the devices, and monitoring compliance. Penalties for noncompliance include immediate re-suspension of driving privileges and an extension of the ISA requirement for an additional six months.

Additionally, the act clarifies liability issues for manufacturers, distributors, or retailers of motor vehicles concerning aftermarket ISA devices and mandates secure data collection and reporting related to the use of these devices. The department is authorized to promulgate rules and regulations to implement the provisions of this chapter. The act is set to take effect upon passage.
