The bill amends sections of the "Public Health and Workplace Safety Act" to introduce new definitions and regulations regarding smoking in pari mutual facilities. It establishes that these facilities must provide designated smoking and nonsmoking gaming areas, which must be physically separated and equipped with distinct ventilation systems to prevent smoke migration. Additionally, any bar or restaurant within a pari mutual facility is required to be nonsmoking and physically separated from smoking areas, with separate ventilation systems. Existing bars that are not physically separated from designated smoking areas are exempt from this requirement.
Furthermore, the bill mandates that pari mutual facility licensees create rules allowing employees the right to work in smoke-free environments, including the right to opt out of working in smoking areas without facing adverse consequences. These rules must be filed with the lottery commission, the general assembly, and the department of health. Licensees are also required to file annual reports detailing their smoke mitigation efforts and air quality monitoring results, with the monitoring process certified by a professional HVAC engineer or other appropriate professional.
The act is set to take effect upon passage, with specific provisions effective from January 1, 2027.
