The bill amends Section 42-7.2-20.8 of the General Laws concerning the ABLE (Achieving a Better Life Experience) program, which is designed to assist individuals with disabilities. The new legal language establishes that, upon the death of a designated beneficiary, an agency or instrumentality of the state shall not seek reimbursement from any ABLE savings trust account or its proceeds for benefits provided to the designated beneficiary, except as required by federal law. This change removes the previous provision that allowed the state of residency to claim funds from an ABLE account upon the death of the designated beneficiary. The act will take effect immediately upon passage.
