It requires that these agreements include provisions that bind all contractors and subcontractors, promote competition regardless of collective bargaining status, and ensure that at least 15% of the total project workforce consists of registered apprentices. If a PLA is not utilized, the state contracting agency must issue a written determination at least 90 days prior to the invitation for bids or request for proposals, explaining why a PLA will not promote an adequate supply of qualified craft labor for the project.

Additionally, local government contracting agencies are authorized to include PLA requirements in their construction contracts. If a PLA is not used, these agencies must require bidders or offerors to submit a certified project craft labor staffing plan, which will be a material term of the construction contract. This plan must demonstrate the staffing capabilities of the lead contractor and all other project contractors, including the specific apprenticeship programs or training programs used to ensure adequate skills for all craft labor classifications needed for the project, as well as the sources relied upon to recruit and deploy qualified craft labor in accordance with project scheduling requirements. The bill emphasizes the protective role of PLAs in safeguarding investments and mitigating performance risks in public works projects.
