The bill amends Chapter 9-1 of the General Laws by adding a new section, 9-1-55, which establishes a cause of action for the recovery of the replacement value of a child restraint system involved in a motor vehicle accident. Under this new provision, any person responsible for a collision with a motor vehicle that contains or employs a federally approved child restraint system, whether occupied or unoccupied, shall be liable to the owner of that system for its replacement value. This liability applies regardless of the lack of any visible damage to the child restraint system.
Additionally, the bill stipulates that the person responsible for the collision or their insurer shall be entitled to take possession of the child restraint system upon payment of the replacement value. This act will take effect immediately upon passage.
