To qualify for certification, technicians must complete a minimum of thirty hours of hands-on experience, participate in an approved training program, pass a certification examination, and undergo a criminal background check. The act specifies the fees associated with licensing and certification, which include a $200 fee for licensure and a $100 fee for certification, both valid for three years. Renewals require continuing education, payment of renewal fees, and proof of compliance with OSFM requirements.
The act also mandates that after inspection or cleaning, a decal indicating the service details must be attached to the kitchen hood. Licensees and certificate holders are required to notify the authority having jurisdiction (AHJ) and the client of any critical conditions discovered during their work within 24 hours.
The OSFM is granted the authority to enforce compliance with the act, including the ability to deny, suspend, or revoke licenses and certifications for violations such as misrepresentation or failure to report critical conditions. Penalties for non-compliance may include fines of up to $1,000 per violation and potential criminal charges for repeated offenses.
This act is set to take effect on January 1, 2029.
