The department has the exclusive authority to enforce the requirements of the act and may impose administrative fines for violations. It can also refer cases to the attorney general for further legal action. Additionally, starting January 1, 2027, individuals who believe their rights have been violated under this act will have the ability to file private lawsuits in the superior court, with potential awards for reasonable attorneys' fees, court costs, and damages for financial, physical, and emotional harm incurred as a result of the violation. The act emphasizes the protection of minors in the digital space and establishes a framework for accountability among social media companies.
