The bill amends Section 45-23-32 of the General Laws in Chapter 45-23, which governs land subdivision in Rhode Island. It introduces a new definitions section that clarifies terms related to land development, including the inclusion of "minor subdivisions" to encompass "single-family infill subdivisions." These infill subdivisions allow for the subdivision of existing lots in areas serviced by public water and sewer, permitting the creation of up to three new lots for single-family detached residential use under specific conditions.
The conditions for single-family infill subdivisions include that the resulting vacant residential lots must each be equal to or greater than seventy-five percent (75%) of the average lot size of all developed residential lots within two hundred feet (200') of the proposed subdivision, excluding multi-family residential lots. Additionally, the lots must be located on an existing improved public street.
The bill stipulates that lots qualifying for this type of subdivision will be reviewed under the requirements and procedures set forth in Section 45-23-38, and they shall not require zoning relief solely based on the reduced lot area of the newly created lots. The resulting subdivided lots will benefit from reduced requirements as outlined in Section 45-24-38 and may be eligible for processes specified in Section 45-24-46, as applicable.
The act is set to take effect immediately upon passage.
