The bill amends Title 23 of the General Laws by adding a new chapter titled "Autologous or Direct Blood Donations." It defines "autologous blood donation" as a person donating their own blood for personal use during a future medical procedure, and "direct blood donation" as a person donating blood specifically for the use of another individual during that individual's future medical procedure. The bill requires that hospitals or healthcare facilities licensed under Title 23 must allow patients scheduled for medical procedures to donate blood if the facility performs blood donations.
Additionally, blood banks that facilitate autologous or direct blood donations must comply with healthcare provider orders for these donations, unless the donor is in ill health, has a heart condition that makes donating inadvisable, weighs too little, or cannot donate for any other reason. Blood banks are permitted to charge their regular fees for facilitating these donations and for storing the donated blood until it is used by the intended recipient. The Department of Health is responsible for promulgating all necessary rules and regulations to implement this section. The act will take effect upon its passage.
