The bill amends Chapter 12-2 of the General Laws by introducing a new section titled "Privacy protections for railway employees." This section establishes that any police report involving a railroad fatality, as well as all communications between police officers and railroad crew members involved in such fatalities, shall not be made public. These reports must be maintained by the responding police department in a manner that ensures confidentiality. However, they will be accessible at all reasonable times, upon written request, to the following parties: (1) the host railroad; (2) the railroad employing any employee mentioned in the reports; and (3) any other person authorized by judicial order to obtain such information if access is necessary for the performance of their duties. Additionally, law enforcement officers and the office of the attorney general may also request access to these reports.

The bill further allows for communications between police officers and railroad employees regarding fatality incidents to be shared with any of the aforementioned parties if such access is necessary for their duties. A violation of this confidentiality provision is classified as a misdemeanor, punishable by imprisonment for not more than one year or by a fine of not more than $1,000, or both. The act is set to take effect upon passage.
