The bill amends Section 21-27-6.1 of the General Laws concerning "Sanitation in Food Establishments" to allow for the manufacture and sale of farm home food products at farmers markets, farmstands, and other retail outlets operated by farmers. It adds pickles and relish to the list of nonpotentially hazardous foods that can be produced and sold without refrigeration, alongside items like jams, jellies, and preserves.
The bill establishes specific requirements for the kitchen where these products are prepared, including standards for equipment, cleanliness, and food safety practices. Each farm home kitchen must be registered with the Department of Health, requiring a notarized affidavit of compliance to confirm adherence to the outlined standards. The registration process includes a fee and the issuance of a certificate that is valid for one year, with provisions for revocation in cases of noncompliance.
Importantly, income generated from farm home food manufacture will not be counted towards farm income for sales and use tax exemptions, nor will related equipment and supplies be exempt from sales and use tax. The act is set to take effect upon passage.
