It addresses the use of class B firefighting foam containing PFAS, prohibiting its discharge for training purposes starting January 1, 2025, and requires manufacturers to notify sellers about restrictions and recall PFAS-containing products by March 1, 2025. The bill enhances enforcement mechanisms by allowing the director to obtain relief in equity or by prerogative writ and mandates that sellers notify purchasers if their firefighting personal protective equipment contains PFAS. It prohibits the sale of such equipment with intentionally added PFAS starting January 1, 2027.
Additionally, the bill establishes a new section for DEM to participate in a multijurisdictional clearinghouse for PFAS-related information, including sharing relevant information and maintaining a database of products containing intentionally added PFAS. It modifies penalties for violations, introducing a tiered penalty system for offenses and reinstating penalties for manufacturers of class B firefighting foam. The act takes effect upon passage.
