The bill amends Chapter 24-8 of the General Laws regarding the construction and maintenance of state roads by adding a new section, 24-8-46. This section grants municipalities the authority to enter into contracts with the Rhode Island Department of Transportation (the department) to perform minor and routine maintenance work ("project work") on the roadway and shoulders of state highways located within their municipal boundaries.

Under this bill, municipalities that complete the project work as described will be relieved from any tort liability arising after the completion of such work, provided that the work conforms to the standards outlined in the contract with the department. Additionally, municipalities are entitled to receive payment or reimbursement from the department for the completed project work that meets the agreed standards. The bill also clarifies that it does not impair, suspend, contract, enlarge, extend, or affect the existing powers and duties of the department, including those specified in chapter 13 of title 42 (department of transportation). This act will take effect upon passage.
