This bill amends Chapter 23-27.3 of the General Laws, known as the "State Building Code," by introducing a new section, 23-27.3-100.1.9, which specifically addresses the applicability of residential energy codes for small homes. It stipulates that the International Energy Conservation Code (IECC) or any successor energy conservation code shall not be automatically adopted or required on a statewide basis for one-family or two-family residential dwellings with a total conditioned floor area of less than 2,000 square feet. Compliance with these energy codes will be determined at the municipal level, allowing local governments the discretion to adopt, amend, or decline these standards based on local priorities, housing affordability considerations, and community needs.

Additionally, the bill clarifies that this exemption does not affect the statewide applicability of energy conservation codes for larger residential dwellings (2,000 square feet or more) or non-residential buildings. It also ensures that the state or municipalities can still offer voluntary energy efficiency programs, incentives, or guidance applicable to residential dwellings of any size. The act is set to take effect upon passage.
