The bill amends Chapter 24-8 of the General Laws regarding the construction and maintenance of state roads by adding a new section, 24-8-46. This new section grants municipalities the authority to enter into contracts with the Rhode Island Department of Transportation (the department) to perform minor and routine maintenance work on the roadway and shoulders of state highways located within their municipal boundaries.
Under this provision, municipalities that complete the project work as described in the contract will be relieved from any tort liability arising after the completion of such work, provided that the work conforms to the standards agreed upon in the contract with the department. Additionally, municipalities that fulfill the contract requirements will be entitled to receive payment or reimbursement from the department for the completed project work.
The bill also clarifies that it does not impair, suspend, contract, enlarge, extend, or affect in any manner the powers and duties of the department, including those outlined in chapter 13 of title 42 (department of transportation). This act is set to take effect upon passage.
