It establishes a "seizure action plan," which is a standardized written, individualized health plan created collaboratively by the parent or guardian, the child's physician, and the school nurse. This plan must ensure access to prescribed medications, provide physician instructions for administering these medications, and outline the recognition of seizure symptoms and appropriate responses.
The bill mandates that parents provide written authorization and a healthcare practitioner's statement before any medication can be administered at school. The healthcare practitioner's statement must include the student's name, the name and purpose of the medication, the prescribed dosage, the route of administration, the frequency of administration, and the circumstances under which the medication may be administered.
Additionally, the Department of Elementary and Secondary Education and the Department of Health are required to issue guidance for the administration of seizure rescue medications, particularly those delivered via nasal route. This guidance will include procedures for parents to authorize school employees to administer FDA-approved seizure rescue medications in emergencies when a school nurse is not immediately available.
The bill outlines training requirements for school staff involved in administering these medications, specifying that training may be provided by licensed healthcare professionals and that school personnel cannot be penalized for refusing to be trained in medication administration. It also ensures that all necessary documentation, including the seizure action plan, is maintained on file and distributed to relevant school personnel and volunteers responsible for the care of students with seizure disorders.
The provisions of this act will take effect upon passage.
