The bill amends Chapter 16-21 of the General Laws, titled "Health and Safety of Pupils," by introducing new sections that establish protocols for managing students with seizure disorders in schools. It defines a "seizure action plan" as a standardized written, individualized health plan designed to acknowledge and prepare for the healthcare needs of a student diagnosed with a seizure disorder. The plan must be created collaboratively by a student's parent or guardian, their physician, and the school nurse and shall include assurance of access to prescribed medications, physician instructions for administering these medications, and recognition of seizure symptoms along with appropriate response steps.
Before any medication can be administered at school, the bill requires that parents provide written authorization and a healthcare practitioner's statement containing specific information about the student and the medication.
Additionally, the bill mandates that the Department of Elementary and Secondary Education and the Department of Health develop policies for administering seizure rescue medications, including those administered via nasal route. It allows parents to authorize school employees to administer these medications in emergencies when a school nurse is not immediately available and requires training for staff involved in this process, specifically in seizure first aid.
The bill also stipulates that a registered nurse's presence can fulfill the requirements for medication administration, and it protects school personnel from liability when acting in good faith according to the seizure action plan. The provisions of this act will take effect upon passage.
