The proposed bill introduces the "Agricultural Equipment Right to Repair Act," which amends Title 6 of the General Laws by adding a new chapter dedicated to the rights of owners and independent repair providers regarding electronics-enabled agricultural equipment. The act mandates that original equipment manufacturers (OEMs) must make available, for purposes of diagnosis, maintenance, or repair, documentation, parts, and tools to independent repair providers and equipment owners on fair and reasonable terms. This includes updates to information and embedded software, ensuring that independent providers can effectively service the equipment without undue restrictions.

The bill defines key terms related to the repair of electronics-enabled agricultural equipment, including "authorized repair provider," "independent repair provider," "documentation," "embedded software," and "trade secret." It clarifies that OEMs are not required to disclose trade secrets beyond what is necessary to fulfill their obligations under the act. Additionally, the act stipulates that existing arrangements between authorized repair providers and OEMs remain intact, particularly concerning warranty and recall work, and any provisions that attempt to waive or limit the OEM's obligations under this chapter are void and unenforceable.

The act allows individuals suffering a loss due to a violation of its provisions to bring a civil action to recover actual damages, reasonable attorneys' fees, and court costs. Furthermore, the attorney general is empowered to enforce the provisions of this chapter through actions for injunctions or other equitable relief. The act will take effect immediately upon passage.
