To enforce these prohibitions, the bill introduces a regulatory framework that empowers the Rhode Island Department of Environmental Management (DEM) to issue cease-and-desist orders for unlawful atmospheric activities. The act mandates that government and armed forces projects comply with its requirements and outlines the responsibilities of state agencies, including the Rhode Island Air National Guard, in monitoring compliance and investigating violations.

Penalties for non-compliance are established, categorizing violations as felonies with fines of up to $5,000 and potential imprisonment for up to five years. The act also allows for a separate offense for each day a violation occurs. An online portal will be created for citizens to report observed violations, and the Rhode Island Department of Labor and Training (DLT) will provide technical training and certification for independent contractors to verify pollution reports. The act is scheduled to take effect on August 1, 2026.
