The bill amends Sections 27-18-57, 27-19-48, 27-20-43, and 40-8-33 of the General Laws to require that all individual or group health insurance contracts issued in the state on or after January 1, 2027, provide comprehensive coverage for all FDA-approved contraceptive drugs, devices, and related services. This coverage includes all FDA-approved contraceptive methods, voluntary sterilization procedures, and associated clinical services, such as consultations, examinations, device insertion, and follow-up care.
The bill prohibits health plans from imposing any cost-sharing requirements, including deductibles, coinsurance, or copayments, for the coverage provided. It mandates that a twelve-month supply of contraceptives can be dispensed at once or over the course of the twelve-month period at the discretion of the prescriber. Additionally, benefits for an enrollee under this section must be the same for the enrollee's covered spouse, domestic partner, and covered non-spouse dependents.
The bill allows religious employers to exclude coverage for contraceptive methods that conflict with their bona fide religious tenets, provided they inform prospective enrollees of such exclusions. It also mandates that Medicaid must cover a twelve-month supply of contraceptives for recipients and prohibits health plans from imposing utilization controls that limit the supply of FDA-approved contraception.
The health insurance commissioner is tasked with monitoring compliance with this section, conducting random reviews of each plan and its subcontractors to ensure adherence, and engaging in a stakeholder process prior to the adoption of rules and regulations. An annual report detailing compliance efforts and findings from the random reviews must be submitted to the General Assembly and made available to the public on the commissioner's website. The bill clarifies that coverage for contraceptive drugs and devices cannot be denied for non-contraceptive medical purposes, ensuring comprehensive access to necessary health services.
