The bill amends Section 45-24-73 of the General Laws regarding zoning ordinances to establish design standards and consistent statewide treatment for accessory dwelling units (ADUs). It allows municipalities to implement regulations concerning ADUs, effective July 1, 2026. These regulations may include:
1. Requiring that primary residences with ADUs be owner-occupied for at least five years;
2. Mandating that ADUs not occupied by family members or caretakers be rented at affordable rates; and
3. Limiting the size of ADUs to 1,000 square feet, without the ability to seek a variance for a larger size.
The provisions of this subsection are enabling and not mandatory, meaning municipalities can choose whether to adopt them.
