The bill amends Chapter 9-21 of the General Laws by adding a new section titled "Judgment lien notice." It requires that within ten (10) business days of recording a judgment lien on real property, the judgment creditor must send written notice to the property owner by certified mail at their last known address. The notice must include the following information: (1) the name and address of the judgment creditor; (2) the amount of the judgment; (3) a description of the property affected by the lien; and (4) instructions on how to satisfy or contest the lien.
The bill also states that failure to provide the required notice does not invalidate the lien but may toll any deadlines related to enforcement until the notice is given. Additionally, the clerk of the court is required to maintain records of judgment lien filings and the notices sent. This act is set to take effect on January 1, 2027.
