The bill amends Chapter 23-4.6 of the General Laws, titled "Consent to Medical and Surgical Care," by introducing a new section on "Consent to hospice care." This new section establishes the rights of patients recommended for hospice services, specifically ensuring that a caregiver, as defined in existing law, is present when hospice services are explained to the patient prior to the patient consenting to those services. It mandates that, if practical, the caregiver shall be present whenever any medical decisions are discussed by the hospice healthcare team with the patient. Furthermore, prior to the patient consenting to hospice services, the caregiver shall be provided with all information regarding the patient's medication and treatment and how entering hospice is anticipated to affect the prescribed medication and treatment.
Additionally, the bill guarantees that hospice patients shall have access to visiting nurse care at home and shall not be excluded from those services because of income or age limitations. This legislation aims to enhance the involvement of caregivers in the hospice care process and ensure equitable access to necessary healthcare services for patients in hospice care. The act is set to take effect upon passage.
