The bill amends Chapter 6-13 of the General Laws, titled "Unfair Sales Practices," by adding a new section, 6-13-22, which requires businesses that impose a surcharge or fee for payments made by credit card to provide clear and conspicuous notice to customers. This requirement will take effect on January 1, 2027. The notice must be posted in a conspicuous location at the point of sale or payment and, for restaurants or food service establishments, must also be clearly displayed on all menus provided to customers. The notice must include a statement that a surcharge is imposed on credit card payments and specify the amount or percentage of the surcharge. Failure to provide the required notice will be considered an unfair or deceptive trade practice and will be subject to enforcement under the existing regulations of the chapter. The act will take effect upon passage.
