The bill amends sections of the General Laws in Chapter 11-47, titled "Weapons," to introduce new definitions and regulations regarding stun guns and electronic dart guns. It defines "stun gun" as a battery-powered handheld device that transmits an electric charge to a person while in contact, and "electronic dart gun" as a handheld device that transmits an electrical current by expelling metal prongs or projectiles.
The bill specifies that individuals aged eighteen (18) years and over may purchase stun guns or electronic dart guns, while prohibiting the sale of these devices to anyone under eighteen (18) years of age. Violators of this provision may face felony charges and imprisonment for up to five (5) years.
Additionally, the bill criminalizes the use of stun guns or electronic dart guns in the commission of a crime, with penalties including a fine of up to ten thousand dollars ($10,000) or imprisonment for up to ten (10) years. It also prohibits the use of these devices against police officers engaged in their duties, with similar penalties applied. Sentences for these offenses must be served consecutively to any sentences for the underlying crime.
Furthermore, the bill states that individuals prohibited from possessing firearms, or those who have been convicted of a felony, are not allowed to purchase, own, carry, transport, or possess stun guns or electronic dart guns.
The act is set to take effect upon passage.
