The bill amends Section 21-28.9-4 of the General Laws under "The Good Samaritan Overdose Prevention Act of 2016" to enhance legal protections for individuals seeking medical assistance during drug or alcohol-related emergencies. It introduces new legal language that establishes immunity from prosecution for individuals who, in good faith, seek help for someone experiencing an overdose, as well as for the individuals in need of assistance themselves. Specifically, the bill ensures that neither party will face charges related to the possession of controlled substances, drug paraphernalia, or underage alcohol possession if the evidence for such charges arises from the act of seeking medical help.
Additionally, the bill expands the scope of immunity to include violations of bail, probation, and/or parole conditions related to these offenses. This change aims to encourage individuals to seek emergency medical assistance without fear of legal repercussions, thereby promoting public health and safety. The act will take effect immediately upon passage.
