The bill amends Section 21-28.9-4 of the General Laws under "The Good Samaritan Overdose Prevention Act of 2016" to enhance legal protections for individuals seeking medical assistance during drug or alcohol-related emergencies. It establishes that individuals who, in good faith, seek help for someone experiencing an overdose will not face charges related to the possession of controlled substances or drug paraphernalia, nor for operating a drug-involved premises, provided that the evidence for such charges was obtained as a result of seeking medical assistance. Additionally, individuals who experience an overdose themselves will also be granted immunity from similar charges under the same conditions.
Furthermore, the bill introduces a new provision that extends this immunity to violations of bail, probation, and/or parole related to the aforementioned offenses. This change aims to encourage individuals to seek emergency medical help without fear of legal repercussions. The act will take effect immediately upon passage.
