The bill amends existing laws related to "Commercial Sexual Activity" by establishing a mandatory "commercial sex buyers accountability program" for individuals convicted of soliciting prostitution or procuring sexual conduct for a fee under sections 11-34.1-3 or 11-34.1-6. Those found guilty, who plead nolo contendere, or are convicted will be required to participate in this educational program and pay a mandatory fee of one thousand dollars ($1,000).
The program aims to increase awareness of the causes of prostitution and its relationship to human trafficking, the health risks associated with prostitution, the consequences of convictions for prostitution or human trafficking, and the long-term harms of these activities on victims.
The bill also outlines the establishment of the program, which may be operated by local governmental entities or approved private providers, and specifies that if a local program is not available, individuals will attend a state program. The funds collected from the mandatory fees will be allocated to the crime victim compensation fund, with a portion distributed to the approved provider of the accountability program and the law enforcement agency involved in the arrest.
The act is set to take effect upon passage.
