The bill amends Section 23-18.18-4 of the "Consumer PFAS Ban Act of 2024" to establish a prohibition on the manufacture, sale, or distribution of products containing intentionally added perfluoroalkyl and polyfluoroalkyl substances (PFAS) in the state. Starting January 1, 2027, no covered products with PFAS may be sold, and by January 1, 2029, specific items such as artificial turf and outdoor apparel for severe wet conditions will also be banned unless they include a clear disclosure stating they are made with PFAS chemicals. The bill outlines the responsibilities of manufacturers and the director of the department regarding compliance and notification of prohibited products.

Additionally, the bill introduces an exemption for certain durable items containing PFAS that are authorized by the United States Food and Drug Administration (FDA) for food contact in consumer goods. This means that cookware and similar items that meet FDA safety standards will not be subject to the restrictions imposed by the Consumer PFAS Ban Act. The act is set to take effect upon passage.
