The proposed bill, titled the "Suicide Prevention--Voluntary Firearm Restrictions Act," aims to establish a process that allows individuals to voluntarily restrict their ability to purchase or possess firearms. Under this act, individuals who are not otherwise prohibited from firearm possession can request to be placed on a restricted list for either a temporary period of 180 days or indefinitely.
The bill defines key terms, including "cohabitant," "healthcare provider," "restricted list," and others. It specifies that individuals can submit their requests for inclusion on the restricted list either in person to a law enforcement agency or through a healthcare provider. The Department of Attorney General is tasked with developing forms for inclusion and removal from the restricted lists, which will collect personal information and be maintained securely.
The act mandates that records related to an individual's inclusion on the restricted list will not be publicly accessible and must be destroyed upon the individual's removal from the list. Individuals can request removal from the restricted list after specified timeframes: after 30 days for the temporary list and after 90 days for the indefinite list. Additionally, the bill includes provisions for the suspension of concealed carry permits upon entry onto the restricted list and their reinstatement upon removal, unless the permit has expired or the individual has become prohibited from possessing a firearm under other laws.
This legislation is designed to enhance suicide prevention efforts while ensuring the protection of individual rights.
